RULES AND REGULATIONS
RENTAL TERMS

Rent is payable one month in advance by no later than the 7th day of each new month for the new month of trade. No daily payments or paying off of stall fees will be accepted.

One months 30 days calendar written notice must be given by stall holders should they wish to cease trading, should stall holders vacate their stall/s with no prior written notice they will be held liable for the rental of the new month.

Stall holders who do not pay their stall fees by the 7th day of every new month will be locked out of their stall/s. Panorama

Flea Market Management reserves the right to confiscate the stall holders goods in lieu of arrears payment. An acknowledgement of debt agreeing to a payment method will be signed by the stall holder. Should the agreement not be upheld the Panorama Flea Market reserves the right to sell the stall holders goods in order to cover the arrears stall fees owing.

Management shall have the right at any time to terminate the stall holder’s hire of the stall without prior notice, therefore, should there be no monies owing for stall fees, any advance rentals shall be refunded in that event.

Stall holders who wish to make use of the credit card facility at the office must come into the Management offices to collect their cash money on the following Saturday after 10am. A transaction fee of 5.5% will be deducted from total transaction amount. No credit card transaction payouts will be offset against stall fees.

Stall holders wishing to sell their stalls MUST liaise with the Panorama Flea Management prior to the transaction taking place, in order for us to update our records with a copy of the new stall holders ID document and a new application form is to be completed. A 20% commission fee of the total selling price of the stall will be issued to the Panorama Flea Market.

No credits will be issued for days of non trade. If any stall holder is unable to trade on any certain day/s you will still be held liable to pay your stall fees for the said day/s not trading.
TERMS AND CONDITIONS OF ALL PERMANENT AND CASUAL TRADERS
CONDITIONS OF TRADE
- All traders must adhere to the rules and regulations of the Panorama Flea Market CC.
- Applicants are only permitted to sell those items of merchandise which are specified on their application form and which have been approved by Management.
- Should any trader add items onto their stall that is not stipulated in their original application form without prior consent from Management, the Panorama Flea Market reserves the right to confiscate the item/s from the stall holder. Should the stall holder continue to sell the unapproved items, the Panorama Management reserves the right to fine the stall holder R500.00 and again confiscate the item/s. Should the stall holder persist in selling the unapproved item/s, Panorama Flea Market reserves the right to ask the stall holder to vacate the stall with immediate effect and no stall fees paid in advance will be refunded to the stall holder unless Management are able to replace the stall with another trader on the next day of trade. If another trader occupies the stall a refund will be given to the previous trader, but should the stall be vacant the trader will not receive a refund for the days that it remains vacant.
- Permission for a stall holder to trade may be withdrawn at any time at the discretion of Management. Their decision is final and not open for negotiation.
- Stall holders who are consistently absent from the Flea Market will be considered a casual trader and will be asked to vacate their stall/s and replaced with another trader. The previous trader will be allowed to trade daily and will be charged the normal daily casual rate of R240.00 for the open air area.
- Management reserves the right to request any trader causing a disturbance to cease trading and vacate the premises.
- Traders must stay strictly within their demarcated stall area.
- Stalls are to be kept clean at all times, refuse to be removed immediately on cessation of trading.
- Food stalls are to follow the rules and regulation as stipulated by the Department of Health
- Management will not permit any stall holder to sell fake, illegal or fraudulent item/s on the premises of the Panorama Flea Market.
- This is constituted as fraud and should you not adhere to this regulation and you are charged accordingly by the South African
- Counterfeit Goods Act, the onus will not rest on the Management or staff of the Panorama Flea Market.
- Management, at their own discretion, can allow any trader to sell and can approve any items to be sold at the market
- Only ONE LINE of items will be allowed per stall, no 2 items that are unrelated may be sold in one stall
- Any permanent fixtures that stall holders wish to add must have prior approval by the management of Panorama Flea Market.
- Permanent fixtures such as building, security doors, floors, shelving etc shall remain the property of Panorama Flea Market. Should the stall holders decide to move stalls, or cease trading, no claim for losses, damages or expenses arising from the fixtures may be made thereto from the Panorama Flea Market.
- Panorama Flea Market reserves the right to remove any fixture that has not gained the prior approval of the Management or that may pose a problem for other stall holders.
- The Management reserves the right to close the Flea Market at its discretion if, in its opinion, circumstances demand.
- The trader will be held liable for any damage caused by the trader to the premises or property of the Panorama Flea Market.
- Any disregard for or contravention of these rules will jeopardise the trading rights. Acceptance of a receipt on payment of fees will serve as agreement of these rules.
- With regards to queries relating to payment of stall fees, no allocation of stall fees will be made unless the trader is able to produce a receipt from the Panorama Flea Market as proof of payment.
CONDITIONS OF ACCEPTANCE OF TRADER
- No stall holder will be allowed to trade without a copy of their identity document or passport.
- Stall holders must agree to a credit check being processed on their application before an agreement can be entered into.
- There is a limit of one registered trader per stall.
- No telephone bookings are accepted and a stall will not be allocated to a trader until payment has been made
- Sub-letting of stalls is not permitted.
- Any specific item is not limited to the selling of one stall holder, unless agreed by Management
- Stalls will not be allocated to a person or religious organisations wishing to promote political or religious activities, collection of signatures, or demonstrations
- Loud hailers/speakers may not be used inside the market.
BOOKING PROCEDURE
- The market is on a permanently booked and casual basis.
- Permanent traders are issued a stall wherein they trade monthly
- Casual Traders will be allocated an open air stall on the day they wish to trade subject to product approval.
PROCEDURE FOR CASUAL TRADERS
- Casual Stall holders are required to be at the Management offices between 7:30am and 8:30am on the day of trade
- No casual stalls will be allocated after 9am
- Stalls are allocated on a first come first served basis, however product type can affect allocation of a stall.
- Fees are payable on allocation of a stall number by Management.
- Management can restrict the right of a trader, or limit the type of merchandise to be sold at the discretion of the Panorama Flea Market.
- Casual Traders are subject to the normal rules and regulations of the Panorama Flea Market.
- Stall number allocations are at the discretion of the management. The stall number indicated on the invoice for the first day of trading is not a permanent allocation, casual stall holders are not guaranteed the same stall should they wish to trade again.
TIMES
- All permanent and casual stall holders must have their stalls erected and open for trade by 9am on every day of trade.
- No permanent or casual stall holder is allowed to close their stalls before 4pm on Saturdays, Sundays and Public Holidays unless agreed to by Management.
SECURITY
- Traders are advised to maintain a “streetwise” awareness with regard to the displaying of merchandise and the handling of money.
- The Management will not be held responsible for personal loss or damage to goods from whatsoever cause arising.
- If an offender is apprehended by a trader, the market security staff should be alerted only if the trader is prepared to lay a charge against the offender.
- Lock up stalls are to ensure that the stall is not left unlocked at the end of each trading day as any theft or loss can not be claimed from the Panorama Flea Market Management or staff.
I HEREBY ACCEPT AND AGREE TO THE RENTAL TERMS AND THE TERMS AND CONDITIONS OF TRADE AND UNDERTAKE TO ABIDE TO ALL THE RULES AND REGULATIONS OF THE PANORAMA FLEA MARKET AS SET OUT ABOVE. I ACCEPT THAT THESE RULES AND REGULATIONS ARE BINDING TO ME AS A TRADER AT THE PANORAMA FLEA MARKET.
